Can I send emails to anyone I want?


Because your emails could be construed as commercial in nature, you will need to be careful not to inadvertently violate the laws regulating the sending of unsolicited commercial emails, such as the CAN SPAM Act of 2003.

 

In a nut shell, an unsolicited commercial email is one whose primary purpose is to promote a commercial product or service and you have not received specific permission from the recipient to send them commercial messages of that nature.

 

The CAN SPAM Act requires that all commercial emails satisfy the following requirements: (i) the sender(s) must be clearly identified in the from line; (ii) the sender(s)’ physical address must be in the body of the email; (iii) the email must include a clear and conspicuous opt-out mechanism that is Internet based to allow people who do not want to receive any more commercial emails from you to tell you so; (iv) the opt-out mechanism must be operational on an ongoing basis for a minimum of 30 days; (v) opt-out requests must be honored within 10 days (you must not send any further commercial emails related to the Commission Program); (vi) the email must be clearly and conspicuously labeled as an advertisement or solicitation (for example “Special Offer”, “Special Promotion” or “Advertisement”); and (vii) the subject line of the email can not be misleading.

 

If you are found to be sending commercial emails in violation of the CAN SPAM Act and other legislation, your subscription to Zlio Services will be terminated.
